total extent of 6 Acres 56 cents by the first respondent based on the petitioner online application along with survey fee application No.20240724016516 dated 24.07.2024, consequently direct the second respondent to provide adequate police protection on the date and time of land survey by the first respondent.

ORDER

The relief sought for in this writ petition is to direct the first respondent to survey in respect of Villupuram District, Gingee Taluk, Thandavasamuthiram Village Survey No's 268/C, 269, 270, 271 which is total extent of 6 Acres 56 cents by the first respondent based on the petitioner online application along with survey fee application No.20240724016516 dated 24.07.2024, consequently direct the second respondent to provide adequate police protection on the date and time of land survey by the first respondent.

2. Mr.L.Baskaran, learned Government Advocate takes notice on 2/7

behalf of the respondents 1 & 2. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.

The case of the petitioner is that the petitioner's grandfather was assigned Settlement order by the Chief Administration officers, Tamil Nadu Archives, in respect of S.Nos.268/C, 269, 270 & 271, Thandavasamuthiram Village, Gingee Taluk, Villupuram District to an extent of 6 Acres 56 cents. This being so, the respondents 3 & 6 try to encroach the petitioner's property comprised in S.No.268/C, which is an extent of 2 Acres 89 cents. In this regard, the third respondent filed a suit in O.S.No.42/2023, seeking permanent injunction against the petitioner in respect of S.No.271/14 and in turn, the petitioner has also filed another suit in O.S.No.131/2023, seeking permanent injunction against the respondents 3 & 6 in respect of S.No.268/3C. These two suits were pending before the District Munsif Court, Gingee.

Thereafter, the petitioner has filed an application through online to survey his land, before the first respondent along with requisite fee and also made a representation dated 18.08.2025 before the second respondent, seeking short police protection, at the time of survey by the first respondent.

However, till date, the said online application was not considered by the first respondent. Hence, the petitioner has come forward with the present writ petition.

4. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that, it would suffice, if this Court issues direction to the first respondent to survey the aforesaid petitioner's property based on petitioner's online application dated 24.07.2024.

5. Learned Government Advocate appearing for the respondents 1 & 2 would submit that the petitioner's online application would be considered and orders passed within a time frame that may be fixed by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

Considering the limited relief sought for by the learned counsel for the petitioner, this Court directs the first respondent to conduct a survey, in respect of aforesaid petitioner's property, after giving due notice and opportunity of personal hearing to the petitioner as well as respondents 3 to 6 and aggrieved persons, if any, within a period of four weeks from the date of receipt of a copy of this order. It is needless to say, in case of any obstruction being created by third parties, the first respondent is at liberty to approach the Police officials/second respondent, in which case, the Police officials/second respondent shall render assistance to the first respondent to carry out the aforesaid exercise.

8. With the aforesaid direction, this writ petition is disposed of. No costs.
