ORDER

This Criminal Original Petition has been filed seeking to quash the proceedings in the FIR in Crime No.359 of 2025 registered under Sections 126(2), 296(b), 115(2), 309(6)and 351(3) of the BNS.

2. The allegations in the FIR are that the petitioner along with one Immanuel, waylaid the defacto complainant and robbed a sum of Rs.500/- at knife point.

3. The learned counsel for the petitioner would submit that the petitioner has no connection whatsoever with the alleged offence and he has been falsely implicated in this case.

4. It is further submitted that the petitioner's son is a doctor and another is an advocate. The charge against the petitioner that he waylaid the defacto complainant is an afterthought and allegations have been falsely foisted against him. Since the local police had demanded some amount from the petitioner's shop and the same was refused the present case has been foisted with malafide intention.

5. Heard the learned Additional Public Prosecutor appearing for the first respondent.

6. On perusal of the First Information Report, it is seen that the defacto complainant has specifically mentioned the name of the petitioner. To unearth the truth, this Court is of the view that the investigation has to be conducted by an officer not below the rank of Assistant Commissioner of Police. 3/5

7. Hence, let the first respondent/ Inspector of Police, G1, Vepery Police Station and the Deputy Commissioner of Police shall conduct the investigation and file a final report.
