ORDER

This Criminal Original Petition has been filed seeking to issue a direction to the first respondent not to harass the petitioner on the basis of the complaint of one Thirumathi.Pushpavathi, the second respondent herein.

The learned counsel for the petitioner submitted that the second respondent has entered into a lease deed with the petitioner on 03.07.2021 in respect of a house building bearing Door No.27, Devananthan Colony, Reddy Kuppam Road, West Mambalam, Chennai; the lease amount was fixed at Rs.20,00,000/- and the petitioner had spent Rs.5,00,000/- for interior decoration which is refundable to him after one year; since there is some misunderstanding between the lessor and lessee with regard to the lease agreement, the second respondent had given a complaint to the first respondent against the petitioner; in view of the said complaint, the petitioner is being harassed by the first respondent police frequently under the guise of enquiry.

3. The learned Government Advocate (Crl. Side) appearing for the first respondent submitted that on the complaint given by the second respondent, current paper enquiry has been initiated in C.No.3593/COP/V/2022 and the same is pending for enquiry.

4. Since the petitioner has stated that the dispute is civil in nature, the first respondent shall follow the guidelines laid down by the Hon'ble Supreme Court in the case of Lalita Kumari Vs. Government of Uttar Pradesh and others [2014 (2) SCC (1)], while enquiring the complaint and do the needful in accordance with law within a period four weeks from the date of receipt of a copy of this order.

5. With the above observation, this Criminal Original Petition is disposed.
