ORDER
Though the present application is only filed under Section 9 of the Arbitration and Conciliation Act, 1996, the learned Senior Counsel appearing for the applicant would submit that a notice invoking the 1/3
arbitration clause has been issued under Section 21 of the Act dated 26.11.2024, in response to the said notice, on 08.01.2025, the respondent has consented to the appointment of M.K.Surendranath, Advocate, as suggested by the applicant.
2.By consent of both the parties, even though formal Section 11 petition has not been filed, Mr.K.Surendranath, Advocate, No.256/3, Pioneer Colony, Anna Nagar (W) Extn, Chennai - 600 101, is appointed as Sole Arbitrator to enter reference and adjudicate the dispute between the applicant and the respondent, in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The learned Arbitrator shall endeavour to conclude the proceedings and publish the final award, within a period of six months.
3.Interim order already granted by this Court in Section 9 application shall stand extended and before the learned Arbitrator, the said application shall be converted as Section 17 application and the interim order shall continue till any further orders are passed by the learned Arbitrator, after 2/3
hearing the parties, in accordance with law. The learned Arbitrator is entitled to fix his fees in terms of the Schedule IV of the Act. 4.With the above directions, the Original Application is disposed of. 21-01-2025 ata Note: Issue order copy on 22.01.2025.
