The present petition has been filed seeking a direction to the respondents to consider the representation made by the petitioner on 28.04.2025 seeking action and police protection within a time frame.

The case of the petitioner is that they have registered the company under the Companies Act for the purpose of setting up manufacturing industry and they entered into a lease agreement to an extent of 7.675 acares situated in Survey Nos.254/1B2, 255/1B, 255/4B, 255/4A, 255/3B and 255/5B, Gudalur Village, Sankari Taluk, Salem District. The petitioner has also applied for Consent to establish the Industry before Tamilnadu Pollution Control Board, which was also granted by the concerned authorities vide Consent Order No.2301250429335 dated 06.06.2023 with a validity period until 31.03.2028. Further, the petitioner also obtained technical clearance from competent authority on 24.02.2024. However, some persons claiming to be villagers obstructing the construction work.
Though the petitioner has obtained necessary permission and license from the appropriate authoities, due to the disturbance by some persons / villagers, the petitioner could not commence the work, for which, the petitioner has also given a representation before the police. Since no action has been initiated, the petitioner has come up with the present petition.
3. The learned counsel for the petitioner brought to the notice of this Court that various licenses / appropriate permissions, which are necessary to commence the construction have been obtained by the petitioner, thereby pleaded to allow the present petition.
4.The learned Government Advocte (Crl.Side), on instructions would submit that the villagers are obstructing the petitioner in setting up the unit.
5. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents and perused the documents placed on record.
6. It is relevant to note that that petitioner was accorded necessary permissions by the concerned departments for setting up a Unit. Further, the Government has also permitted the petitioner to construct the Unit and the petitioner has also obtained the lands on lease, while so, others/villagers have no business to obstruct the same.
7. In such view of the matter, the 3rd respondent is directed to consider the representation of the petitioner dated 28.04.2025 and accord necessary police protection when any person interferes with the possession / construction of Unit of the petitioner.

Accordingly, this Writ Petition stands disposed of with the aforesaid direction. No costs.
