Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus to consider the petitioner's representation dated 04.08.2025 within a time frame fixed by this Court and to direct the 3rd respondent to issue NOC in respect of the subject property plot No.146 situated in S.No.7/3, Saravanampatti Village, Coimbatore Taluk of Deiveega Nagar.

of the respondents 1 to 5. Since the Writ Petition is taken up for disposal at the stage of admission and considering the nature of relief to be granted herein, notice to the sixth respondent is dispensed with.

This Writ Petition is filed seeking for issuance of a mandamus to consider the petitioner's representation dated 04.08.2025 within a time frame fixed by this Court and to direct the 3rd respondent to issue NOC in respect of the subject property plot No.146 situated in S.No.7/3, Saravanampatti Village, Coimbatore Taluk of Deiveega Nagar.

Learned counsel for the petitioner would submit that the petitioner's wife (since deceased) was the owner of the subject property; that the petitioner's wife died intestate on 04.08.2010, leaving behind the petitioner and two sons as her legal heirs to inherit the property; though the subject property was purchased by the deceased wife prior to 03.08.1976, and is not affected by Urban Land Ceiling Act, since the registering Authorities are insisting for NOC for the purpose of registering the property in the petitioner's name, the petitioner made a representation to the third 3/7

respondent dated 04.08.2025 seeking to issue NOC; that since the said representation evoked no response, the petitioner has filed the present Writ Petition seeking for aforesaid relief.

4. The learned Government Advocate for the respondents 1 to 5 would fairly submit that the representation made by the petitioner would be considered and disposed of in accordance with law within the time, as stipulated by this Court.

In view of the submission made by the learned Government Advocate for respondents 1 to 5 and considering the limited scope of the prayer, sought for by the petitioner, in this Writ Petition, this Court, without expressing any view with regard to the merits of the contentions putforth by the petitioner in the Writ Petition or in the representation, is of the view that, suffice it would be to direct the third respondent to consider and dispose of the petitioner's representation in a time bound manner. 4/7

6. Accordingly, the Writ Petition is disposed of with a direction to the third respondent to consider the representation made by the petitioner dated 04.08.2025 and dispose of the same as early as possible, preferably, within a period of four weeks from the date of receipt of a copy of this order. No costs.
