M/s.Sree Balaji Traders, represented by its Partner Ms.Sowmya .. Applicant vs Geoscope Exim Private Limited, rep. by its Senior Manager Authorised Signatory P.Prakash and another .. Respondents This application has been filed seeking to condone the delay of 282 days in re-presenting the written statement.

2.Learned counsel for the first respondent/plaintiff has stated no objection for allowing this application.

3.It is represented by both the learned counsels that they were under the impression that the written statement has already been taken on record by the registry. But when the matter was listed for arguments after completion of recording of oral evidence, it was informed that the written statement has not been brought on record, which became necessary for the applicant to file the present application seeking to condone the delay.

A. No.5750 of 2023 in C.S. (Comm.Div.) No.27 of 2022 vga 4.This Court is satisfied with the reasons stated in the affidavit filed in support of this application as sufficient cause has been shown for condoning the delay.

5.Accordingly, this application is allowed as prayed for and the written statement is taken on file.

6.The issues have also been framed by this Court and the matter is ripe for arguments. Both the counsels are ready to argue the matter once the date is fixed. Post the suit for arguments on 21.11.2023.
