ORDER

This Writ Petition is filed for a writ of Mandamus directing the respondents herein to consider the petitioner's representation dated 20.09.2023 to peruse all the documents and restore the patta No.614 in the name of the petitioner's mother Jayarani.

The contention of the petitioner is that the manual Patta stands in his mother's name and after her death, the petitioner had applied for transfer of patta from the name of his mother to his name with the death certificate of his mother and also legal heirship certificate enclosed. Though the manual patta stands in the name of the petitioner's mother, after digitalization, the same has not been carried out in the computer and the respondents are dragging on the matter stating that the name of the petitioner's mother is not found in the computer records. Hence, the petitioner is constrained to approach this Court. 2/5

3. It is seen from the records that the property stands in the name of the mother of the petitioner and the Patta also stands in her name.

Therefore, in the light of limited prayer sought for in this petition and the submissions made by the learned counsel on either side, without going into the merits of the case, this Court directs the respondents to consider the petitioner's representation dated 20.09.2023 and conduct enquiry in the manner known to law after giving notice to all the interested parties and rival claimants if any and pass appropriate orders in accordance with law, as expeditiously as possible provided within a period of three months from the date of receipt of copy of this order.

5. With the above directions, the writ petition is disposed of at the admission stage itself. No costs.
