Heard Mr. J.Nagarajan, Learned Counsel for the Petitioner and Mr. S.T.Mohamed Sathik, Learned Government Advocate, who takes notice for the Respondents and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed for directing the First Respondent to release the bidding sum of Rs.9,90,000/- towards the completion of the construction of compound wall around the integrated house in the First Respondent's Municipality vide his proceedings Na. Ka. No.2006/2019/,1, dated 29.08.2019.

Learned Government Advocate appearing for the Respondents states that the concerned authority would make the payment due to the Petitioner shortly. In view of the same, Learned Counsel for the Petitioner seeks permission of the Court to withdraw the Writ Petition reserving the rights of the Petitioner to pursue his legal remedies, if such payment is not made, before the proper forum in the manner recognized by law and he has made an endorsement to that effect 2/4

in the court record.

In fine, the Writ Petition is dismissed as withdrawn with the aforesaid clarifications. No costs.
