Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the third respondent to transfer the patta in the name of the petitioner in respect of the properties being all that piece and parcel of land comprised in Survey No.267/3 to an extent of 54 cents, S.No.280/1C (1 part) to an extent of 3450 sq.ft. and S.No.280/3 to an extent of 3200 sq.ft. totally to an extent of 69 cents situate at Arigilapadi Village, Arakkonam Taluk, Ranipet District based on the representation of the petitioner dated 06.09.2024.

O R D E R

The petitioner herein seeks a direction to the third respondent to transfer the patta in his name in respect of the properties in Survey No.267/3 measuring an extent of 54 cents, S.No.280/1C (1 part) measuring an extent of 3450 sq.ft. and S.No.280/3 measuring an extent of 3200 sq.ft., in total, 69 cents situated at Arigilapadi Village, Arakkonam Taluk, Ranipet District, by considering his representation dated 06.09.2024.

2. By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

3. It is the case of the petitioner that the above mentioned property was allotted to the petitioner's father Ramachandran under family partition deed dated 09.07.1970. The petitioner's father died on 04.05.1985 and the 2/5

petitioner's mother died on 13.12.2000 and the petitioner, his wife, his children and deceased brother Kuppusamy are the only legal heirs. The petitioner submitted a representation dated 06.09.2024 seeking transfer of patta in the name of all the legal heirs and the same has not been considered till date. Therefore, the petitioner is before this Court.

The learned counsel for the petitioner submits that the petitioner made on-line applications seeking transfer of patta and the same have not been considered by the third respondent and hence, he filed the representation dated 06.09.2024. In the typed set of papers, copies of the said online applications dated 04.09.2024 and 05.09.2024 relating to S.No.280/1C and 280/20 respectively, have been enclosed.

5. Mr. A.Selvendran, learned Special Government Pleader, who takes notice for the respondents would submit that the representation of the petitioner would be considered on its own merits and appropriate orders will be passed.

6. In view of the above submission made by the learned Special 3/5

Government Pleader, without going into the merits of the claim made by the petitioner, this Court is inclined to issue a direction to the third respondent to consider the representation of the petitioner dated 06.09.2024 and pass final orders, after issuing notice to all interested parties, within a period of six weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition is disposed of. No costs.
