O R D E R

The petitioner herein seeks a direction to 3rd respondent to disconnect the electricity connection issued in favour of 4th respondent in service numbers 55 and 207 and transfer the electricity connection for Survey No. 78/2 measuring an extent of 17 acres to the Panchayat Board of Thirukunam Village, T.Kosappalayam Anniyur Post, Vikravandi Taluk as per proceedings dated 30.03.2023.

2. Mr.V.Venkata Seshaiya, learned Standing Counsel (TNEB) takes 2/6

notice for the respondents 1 and 3 and Mr.G.Ameedius, learned Government Advocate takes notice for the 2nd respondent.

3. Since no adverse order passed against the 4th respondent, the notice to him is dispensed with.

4. It is the case of the petitioner that 4th respondent illegally occupied Government Eri Poramboke and obtained service connection for the building situated in that area. In this connection, the 2nd respondent already addressed a letter to 3rd respondent in Na.Ka.No.A2/9146/2022 dated 30.03.2023 requesting the 3rd respondent to take action for dis-connection of the electricity service connection.

5. The learned Standing Counsel (TNEB), who is taking notice for the respondents 1 and 3, submits that necessary notice will be issued to the 4th respondent and final orders will be passed on the request made by the 2nd respondent in accordance with the law.

In view of the same, without going into the merits of the claim made by the petitioner, the 3rd respondent is directed to conduct an enquiry pursuant to the communication of the 2nd respondent dated 30.03.2023 and pass final orders on its' own merits after issuing necessary notice to the 4th respondent within a period of six weeks from the date of receipt of copy of this order.
