This Court, earlier in Crl.O.P.No.19757 of 2023 while considering the bail petition of this petitioner who is the prime borrower and have cheated by using fake document, declined to grant bail taking note of the fact that the petitioner was secured after issuing Non Bailable Warrant. He was at large for more than four years, which has caused the delay in progress of the trial initiated in the year 2006. Again this petitioner is before this Court seeking bail.

The learned counsel appearing for the petitioner submitted that the petitioner is ready to deposit the money cheated and therefore, seeks indulgence of this Court to consider the bail petition sympathetically. 3.
If the petitioner without prejudice to his defence, deposits the amount alleged to have been cheated, the trial Court shall consider the fact and pass appropriate order.
