ORDER
When the matter came up for hearing, it is represented that the victim has since received compensation. The address of the accused is in Maharashtra and the matter has been pending for execution of warrant for the past six years. It is stated that despite best efforts, the police are not able to trace the correct address or the accused. The likelihood of conducting a meaningful trial is not possible and even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is Page No.1 of 3
unlikely, and no useful purpose would be served.
2. Accordingly, the case in C.C.No.1020 of 2019 on the file of the Judicial Magistrate No. 3, Erode Taluk, Erode shall stands quashed and this Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
