ORDER

The allegation in this case is that, on 18.05.2018, the accused stealthily broke open the lock of the vehicle of the complainant bearing registration no.TN 25 AV 0902 Mahindra Maximo van and took away a sum of Rs.1,000/- 2.

The accused was apprehended and the amount was recovered and it was handed over to the defacto complainant. However, subsequently, the accused is elusive and is not residing in the address given and the case is now pending from the year 2018.

Considering the nature of the case, and even if in future, warrant is executed, the same will impinge upon the right to speedy trial of the accused and as such, no useful purpose will be served in keeping the matter pending. 4.

Accordingly, the proceedings in C.C.No.23 of 2019 on the file of the learned Judicial Magistrate Court, Sholinghur Taluk, Ranipet is quashed and this Suo Motu Transfer Case is allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
