ORDER
This occurrence was on 21.05.2016. The allegation is that the first accused stole a Nokia model mobile phone from the defacto complainant and the other accused are said to have received the same. The accused are from Karnataka and Andhra and they are untraceable. The matter has been pending at the stage of service of summons / execution of warrant for the past 9 years. Even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

2. Accordingly, the case in C.C.No.1800173 of 2016 on the file of the Judicial Magistrate III, Salem Taluk, Salem shall stands quashed and this Suo Motu Transfer Case stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
