ORDER
The allegation in this case is that, on 20.04.2021, a total number of four persons were found to be stealing the batteries from the two wheelers and at that time, they were caught red handed. As a matter of fact, A1 to A3 pleaded guilty and the case against them is over. As far as A4 is concerned, the case is pending from the year 2021 for want of service of summons. Thereafter, warrant is issued and the same is also pending for surety action. Page No.1 of 3

Considering the nature of allegations and the manner in which the case is kept pending for the past 4 years, I am of the view that no useful purpose will be served in continuing the case. Even if the accused is brought to books, the sheer delay will prejudice the defence of the accused. 3.
For all the above reasons, no purpose will be served in keeping the matter pending. Accordingly, C.C.No.64 of 2021 on the file of the learned Judicial Magistrate Court No.II, Ariyalur Taluk, Ariyalur is quashed and this Suo Motu Transfer Case is allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
