ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 20.08.2018, the accused protested with the tank operator stating they are not getting water supply to their village. During which, they have said to have broken the pipe. As such when the case was registered in Crime No.504 of 2018 for the alleged offences Page No.1 of 3

under Sections 430 and 506 (i) of IPC on 23.08.2018, a final report having been filed on 25.08.2018. The accused regularly appearing before the Trial Court. However, the trial has not yet proceeded.

3. For the nature of offences, the accused has been facing the proceedings for the past seven years. Continuing the case hereafter will serve no purpose and would impinge upon the right to speedy trial of the accused. Under the said circumstances, the CC. No.210 of 2020 on the file of the Court of Judicial Magistrate, Omalur Taluk, Salem, shall stand quashed and the Suo Motu Transfer case stands disposed of.

21.08.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
