ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 05.11.2019, the motor cycle belonging to the defacto complainant bearing Registration No.TN 05 AU 9559 was stolen by the respondents herein. Subsequently, the case was solved and the accused was apprehended and the motor cycle was recovered and Page No.1 of 3

handed over to the defacto complainant. From 23.09.2021 onwards, this case has been taken cognizance and it is pending for service of summons. All the efforts taken to serve the summons have not fructified so far. Accused No. 2 was never apprehended, and his address was neither mentioned nor verified; he has been shown as an absconding accused.

3. Under these circumstances, there is no real prospect of the case being further conducted. The occurrence happened in the year 2019 and even if summons is going to be served on the accused hereinafter, the same will impinge upon their right to speedy trial. Therefore, the proceedings in C.C.No.7092 of 2021 on the file of the V Metropolitan Magistrate, Egmore Taluk, Chennai, shall stand quashed and the Suo Motu Transfer stands disposed of.

21.08.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
