ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 10.11.2017, the two wheeler and the Samsung Cell Phone which was kept in the tank cover belonging to the defacto complainant was stolen. Subsequently, the accused were apprehended and the two wheeler was recovered and the properties were also recovered and handed over to the defacto complainant.

3. Under the said circumstances when this occurrence was happened in the year 2017 and when the case was pending from the year 2018, the summons were served for the hearing on 08.10.2018, both the accused did not appear and from then onwards for the past seven years Non-Bailable Warrant is pending. It is stated that both the accused are not in their respective addresses and inspite of best efforts of the police their whereabouts could not be traced out.

4. In view thereof, considering the fact that the two wheeler has been recovered and handed over to the defacto complainant, the accused remained elusive and not traceable for the past seven years, no useful purpose will be served in keeping the matter pending further. Accordingly, the C.C.No.900026/2018 on the file of the Judicial Magistrate Court No. II, Ariyalur Taluk, Ariyalur stands quashed and this Suo Motu Transfer stands disposed of.

21.08.2025 Jer alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
