ORDER

This Criminal Original Petition has been filed to modify the condition imposed in para 5 (i) in the order passed in Crl.M.P.No.943 of 2025, dated 29.07.2025 passed by the Principal Sessions Judge, Thiruvarur that the Petitioner shall make non-refundable deposit to the tune of Rs.30,000/- to the President, Advocate Clerk Association, Thiruvavur.

The learned counsel for the petitioner submitted that at the time of granting anticipatory bail to the petitioner on in Crl.M.P.No.943 of 2025, the learned Principal Sessions Judge, Tiruvarur has imposed conditions and one of such conditions is that the petitioner shall make non-refundable deposit for a sum of Rs.30,000/- to the President, Advocate Clerk Association, Thiruvarur. He further submitted that the condition imposed on him is too onerous and owing to petitioner's financial constraints, he is not in a position to mobilise funds, so as to deposit the same before the Advocate Clerk Association. Thus,

he prayed for modification of the above said condition imposed on him by the court below.

3. Heard the learned Govt. Advocate (crl.side) appearing for the respondent.

4. Considering the submissions of the learned counsel for the petitioner, the condition No. 'i)' imposed by the Principal Sessions Judge, Tiruvarur in Crl.M.P.No.943 of 2025 on 29.07.2025 is modified to the effect that the petitioner shall deposit a sum of Rs.15,000- (Rupees fifteen thousand only) before the President, Advocate Clerk Association, Thiruvarur within a period of one week from the date of receipt of a copy of this order and proof of payment of the same shall be filed by the petitioner before the learned District Munsifcum Judicial Magistrate, Nannilam.

5. Except the above modification, the other conditions imposed on the petitioner shall remain unaltered.

6. With the above modification, this Criminal Original Petition is disposed of .
