ORDER
The allegation in this case is that on 25.03.2012 on account of the enmity between both sides with reference to plying the buses on the same route and getting most number of passengers, the accused are said to have come to the spot near the bus stop and when the defacto complainant was driving the bus and passengers were alighting, they had said to have abused him and also hit him with hands and also by showing the petrol can and threatened to burn the bus. There was also minor injuries to the defacto Page No.1 of 3
complainant.
2. On the strength of the said allegations, a case was registered in Crime No.150 of 2012 on 28.03.2012. Thereafter, when the final report was filed, the accused No.2 alone regularly appeared and therefore, the case against him was split up and by a judgement in CC.No.7 of 2018 the accused No.2 was also acquitted on merits. These two accused remained elusive and service could not be effected to them till date. In view of the fact that the other accused have been tried on merits and acquitted and the further considering the nature of allegations, I am of the view that no useful purpose will be served in keeping the case pending accordingly, the case in C.C.No.82 of 2019 on the file of Judicial Magistrate Court No.II, Jayamkondam Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is disposed of. 21.08.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
