ORDER

The allegation in this case is that, on 17.11.2011 the accused drove a lorry bearing Regn.No.TN 32 B 2035 in a rash and negligent manner and hit against the two wheeler in which the deceased and the injured witness were travelling. Accordingly, the case was registered in Crime No.354 of 2011 on 17.11.2011. The final report was filed and on 11.06.2012 and was taken on file as Crime No.75 of 2012. The address that was given by the accused is Amankanthondi Village in Jayankondam District. It is stated by the police Page No.1 of 3

that, in that remote village, the accused had only stayed in a rental house and thereafter, without informing anybody, has gone away from the said Village. Nobody knows the address or whereabouts of the accused. For the past fourteen years, the accused has remained elusive.

2. In view of the facts and circumstances and considering the nature of accident that is said to have happened, I am of the view that even in future if the summons is served, the right to speedy trial of the accused would stand vitiated and as such no useful purpose will be served in continuing the case and accordingly the case in C.C.No.100316 of 2012 on the file of Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is disposed of.

21.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
