ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that when the complainant withdrew a sum of Rs.1,99,000/- from the bank, the first accused stole the money and thereafter handed over to the second accused. The entire amount was recovered and the de facto complainant who is present before this Court submits that she has received the same lost by her. The second accused is also Page No.1 of 4

present. The first accused remains untraceable. Even upon enquiry with the de facto complainant, she states that the first accused has gone away to some other place and not available. The submission made by the Police that inspite of best efforts, no summons could be served on the first accused, seems to be correct. The case is pending from the year 2014 and the second accused is facing the case.

3. Considering the nature of allegations, the recovery, already the arrest and remand of the arrest and remand of the accused and thereafter letting the on bail and the matter is pending from the year 2014, no meaningful trial can be held from hereon. The right to speedy trial of the second accused also stands violated in view of the fact that the summons could not be served on the first accused.

4. In view of the above, the case in C.C.No.100093 of 2015 on the file of the Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur, stands quashed. This Suo Motu Transfer Case is disposed of. 26.08.2025 grs Page No.2 of 4

electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.3 of 4
