This Criminal Miscellaneous Petition has been filed seeking to cancel the anticipatory bail granted to the 2nd respondent/accused in Crl.O.P.No.17985 of 2019 dated 14.11.2019 by this Court, in Crime No.5 of 2019 on the file of the first respondent Police.

2. The learned counsel for the petitioner/defacto complainant submitted that this Court vide order dated 14.11.2019 in Crl.O.P.No.17985 of 2019 granted anticipatory bail to the 2nd respondent with certain conditions but the 2nd respondent/accused has not complied with the condition as imposed by this Court. Hence he prays for cancel the anticipatory bail to the 2nd respondent herein.

3. Heard the learned Government Advocate (Crl.Side) appearing for the first respondent.

4. The learned counsel for the 2nd respondents submitted that the 2nd respondent/accused is regularly complying with the condition as imposed by this Court. Hence, he prays to dismiss the petition.

Considering the facts and circumstances of the case and also the fact that after obtaining anticipatory bail, the second respondent has not complied with the order dated 14.11.2019 as imposed by this Court and she has not co-operate with the investigation, if the anticipatory bail is continued, there is every possibility for tampering the witnesses and may abscond either during investigation or trial

6. In view of the above, the anticipatory bail granted by this Court by order dated 14.11.2019 in Crl.O.P.No.17985 of 2019 is hereby cancelled.
