This application has been filed by the 1st defendant to condone the delay of 57 days in filing the written statement of D-1 in the suit.

2. Since there was no objection on the other side and having regard to the nature of the allegations found in the affidavit with regard to the delay and in order to give a fair opportunity to the applicant herein to agitate its rights, I am inclined to condone the delay.

3. Accordingly, this application is allowed.

4. The 2nd defendant has not filed the written statement and called absent and set exparte.

5. The Registry is directed to post the main suit on 19.11.2023 for framing issues along with O.P.No.615 of 2023.
