ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. In this case, the allegations is that on 01.05.2021, the Samsung phone belonging to the defacto complainant worth Rs.9000/- was stolen from his house when the defacto complainant had kept open the main door and was sleeping. The name of the accused itself is mentioned as suspicion. Thereafter, Page No.1 of 3

the accused was apprehended and the cell phone was recovered and handed over to the defacto complainant.

3. However, it can be seen that for his avocation, the accused has left the place and his present address could not be traced out and even though the case is pending from 09.08.2021, the summons could not be served.

4. Considering the nature of allegations, even if on a future date, the summons is served, it will impinge upon the right to speedy trial of the accused. As such, no useful purpose will be served by keeping the matter pending. Accordingly, CC.No.75 of 2022 on the file of Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur is quashed and this Suo Motu Transfer case is disposed of.

21.08.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
