ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. In this case, the allegation is that, on 16.10.2015 when the defacto complainant was lying down in the front yard of his house, the accused belonging to the same street, abused him in filthy language and also hit him Page No.1 of 4

with hands and legs. On the said allegations, a case in Crime No.311 of 2015 was registered on 17.10.2015.

3. Totally three accused were tried in this case. A1 did not appear before the Court and as such, the case was split up in respect of A2 and A3 and the trial was conducted and on merits A2 and A3 are already acquitted in C.C.No.72 of 2018. A1 is not served with the summons till date. It is stated on behalf of the Police that he has gone away from the street and his whereabouts are not at all known.

4. In view of the fact that the offence is of the year 2015, any service of summons in future would also impinge upon the right to speedy trial of the accused No.1 and considering the fact that the other accused stood trial and were acquitted on merits, no useful purpose will be served in keeping the case pending accordingly CC.No.26 of 2021 on the file of the Judicial Magistrate Court No.II, Jayamkondam Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is disposed of.

accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
