The petitioner herein was arrested on 07.07.2025 in connection with Spl.S.C.No.9 of 2025 in Crime No.41 of 2025 for the alleged offence under Section 12 of POCSO Act.

2.Originally, the petitioner was arrested in connection with the Crime No.41 of 2025 and bail was granted by this Court in Crl.O.P.No.14544 of 2025 dated 14.05.2025. Subsequently, due to non-compliance of the bail condition, the bail was cancelled by the Sessions Court and thereafter, he was arrested on 07.07.2025 and the trial progressing. 3.The learned counsel for the petitioner submitted that the defacto complainant's father is an influenced person and due to his influence separate false complaint has been registered and on that basis, the bail was cancelled by the trial Court. He further submitted that the petitioner is ready to abide by any stringent condition imposed by this Court and ready to stay out of the district.

4.Per contra, the learned Public Prosecutor appearing for the respondent, reported that the petitioner is a history sheeter with 14 previous cases registered against him. He further submitted that if the petitioner is released on bail, there is every possibility of absconding and there is likelihood that he may threaten the victim girl. He further submitted that trial in Spl.S.C.No.9 of 2025 has commenced and PW-1 to PW-3 have already been examined. The next batch of witnesses to be examined. 2/5

5.Considering the fact that the petitioner is have several previous and already bail granted to him was not properly used by the petitioner and violated the bail conditions, which resulted in cancellation of bail. At this stage, this Court is not inclined to grant bail to the petitioner.
