ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. The allegation in this case is that on 04.03.2014, totally 3 accused were said to have abused the defacto complainant in filthy language and also hit him with hands and also threatened them. As such a case was registered in Page No.1 of 4

Crime No.35 of 2014 for the alleged offences under Sections 294(b), 323, 355 and 506(ii) of IPC, 1860. The final report was also filed on 03.05.2014 and was originally taken on file in the year 2017.

3. It could be seen that A1 and A3 have since died. A2 Ramayee who started facing the case in the year 2014 when she was 45 years of age is attending the case for the past ten years and now she is aged 55 years.

4. Considering the role played by her and the fact that the other accused have since also passed away and the trial has not yet commenced, conducting trial hereinafter would be violating the right to speedy trial of the accused. Further, it is stated on ground also, the enmity is not as such as it was there in the year 2014.

Considering all the above, since no useful purpose will be served by keeping the matter pending, the case in CC.No.100065 of 2017 on the file of Judicial Magistrate Court No.I, Jayamkondam Taluk, Ariyalur stands quashed and this Suo Motu Transfer case is disposed of. 21.08.2025 rap Page No.2 of 4

electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. Page No.3 of 4
