Heard Mr.A.M.Ravindranath Jayapal, learned counsel for petitioner and Ms.Rajashree, learned counsel for respondents 1 & 2.

This petition is filed to condone the delay of 244 days in filing the writ appeal.

Learned counsel for respondents 1 & 2 opposes the petition on the ground that no sufficient cause is mentioned.

It is trite that if the technical considerations and cause for substantial justice are pitted against each other, the cause for substantial justice has to be subserved.

We have gone through the accompanying affidavit. For the reasons mentioned in the accompanying affidavit, the delay of 244 days in filing the appeal is condoned. Accordingly, the petition stands allowed and is disposed of.

Post the writ appeal on 27.11.2023 for admission.
