Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the respondent to consider the representation of the petitioner dated 30.04.2024 seeking to levy property/house tax in respect of the House Property situated at S.F.No.685/3D, Perumpathy Zaminkalipuram Post, Pollachi Taluk, Coimbatore District and consequently direct the respondent to permit the petitioner to make payment through online.

ORDER

This writ petition has been filed to direct the respondent to consider and dispose of the petitioner's representation dated 30.04.2024.

2. Mr.K.Suresh, learned Government Advocate, takes notice on behalf of the respondent. By consent of the parties, the main writ petition is taken up for disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that the petitioner had obtained building permission from the respondent on 06.01.2023 and paid House Tax regularly. Under these circumstances, when the petitioner made an attempt for making payment of house tax for the assessment year 2023-24 through online, he was unable to do so. In this regard, the petitioner had also filed a representation dated 30.04.2024 before the respondent. However, the same was not at all 2/5

considered by the respondent till date. Hence, this petition has been filed.

4. In reply, the learned Government Advocate appearing for the respondent would requests this Court to pass appropriate orders directing the respondent to consider and dispose of the representation made by the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondent and also perused the materials available on record.

6. In the case on hand, it was contended by the petitioner that he was unable to pay the house tax for the assessment year 2023-24 through online. In this regard, a representation dated 30.04.2024 has also been filed by the petitioner. However, the same was not considered by the respondent till date.

7. In view of the above, this Court directs the respondent to consider the representation filed by the petitioner dated 30.04.2024 and dispose of the same on its own merits and in accordance with law within a period of 4 weeks from the date of receipt of a copy of this order.

8. With the above directions, this writ petition is disposed of. No costs.
