ORDER

The allegation in this case is that on 17.07.2019, when the de facto complainant was proceeding in his motor cycle, the accused drove the Car bearing registration No.TN45 AP 4512 in a rash and negligent manner and hit against the motor cycle, in which, the motor cycle rider and the pillion rider suffered injuries. Immediately thereof, they were advised that they will talk amicably with the Car owner. After going to the hospital and after two days, they were advised to give the complaint and therefore, they lodged the Page No.1 of 4

complaint.

2. On the strength of the same, an F.I.R was registered on 19.07.2019 and the Final Report was filed on 14.11.2019. However, for the past six years, the matter is pending for service of summons on the accused. The nature of allegations is taken into account. Secondly, even if summons are served on a future date, that would impinge upon the right of speedy trial of the accused. No useful purpose will be served by keeping this matter pending.

3. Accordingly, the case in S.T.C.No.11 of 2021 of Judicial Magistrate Court No II, Jayamkondam Taluk, Ariyalur stands quashed. This Suo Motu Transfer Case is disposed of.

21.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
