ORDER

The allegation in this case is that on 01.08.2013, when the de facto complainant was travelling in a bus, the accused picked a sum of Rs.500/- from the pocket of the de facto complainant. Immediately upon realising the same, the de facto complainant gave a chase to the accused and caught hold of him and recovered the said 500 rupee note also.

2. It is under this stage, an F.I.R was registered as Crime No.935 of Page No.1 of 4

2013 for the alleged offence under Section 379 of the Indian Penal Code. Thereafter, the Final Report is also filed and the same is pending. Since the accused remained elusive, a warrant is also now issued and the warrant is pending. Considering the fact that the accused was also initially attending the case for several hearings and taking the overall allegations in this case and the fact that the case is pending from 01.08.2013, I am of the view that even if the accused is brought to attend the case, for the nature of allegations, in view of the time lag, it will impinge upon the right to speedy trial. No useful purpose will be served in keeping the case pending.

3. Accordingly, the case in S.T.C.No.41 of 2020 on the file of the learned Judicial Magistrate No.2 Court, Wallajahpet Taluk, Ranipet, stands quashed. This Suo Motu Transfer Case is disposed of. 21.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
