ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. The allegation in this case is that the accused attempted to steal a two wheeler at that time itself the complainant saw the same and for the said allegations the case is pending from the year 2021. The accused has got no other previous or subsequent case.

3. In view of the nature of the allegations, even if summons is served on any future date, the same would impinge upon the right to speedy trial of the accused. Accordingly, the case in CC.No.11 of 2023 on the file of the Judicial Magistrate Court No.II, Kallakurichi Taluk, Kallakurichi stands quashed and this Suo Motu Transfer case is disposed of.

01.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
