The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406, 420 and 506(i) IPC in Crime No. 175 of 2023, seeks anticipatory bail.

2. The brief facts of the case:

The defacto complainant lodged a complaint before the respondent police stated that the petitioner is running real estate company under the name and style of Vishnuvarthan Impex and Agency and he need funds to construct the building. So also, he assured to give 2/3 profit to the defacto complainant. By believing the words of the petitioner the defacto complainant given a sum of Rs.38,00,000/- to the petitioner and also one Amalraj and Ezhumlai given Rs.5,00,000/- and 3,00,000/- respectively. Thereafter, the petitioner came to know that the said company is fake. When the defacto complainant asked about the said amount he was threatened by the petitioner. Hence the case.

3. Considering the gravity of the offence, the petitioner has

cheated the defacto complainant and others to the tune of Rs.48 lakhs under the guise of giving high return to the invested amount and also no amount was recovered from the petitioner. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this petition is dismissed.
