ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 15.06.2019, when the deceased was walking along the left hand side of the road, the accused drove the Maruti Car bearing Registration No.TN 65 J 3667 in a rash and negligent manner and dashed against the deceased. On account of which, he was injured. Initially, a case was registered for an offence under Sections 279 and 337 of IPC and thereafter since the injured succumbed to the injuries, the offences are altered to 304 - A of IPC. The case was pending from the year 2019.

3. When the matter came up for hearing firstly, it is informed that the dependents of the deceased have already filed Claim Petition and the claim has also been awarded by the Tribunal. Thereafter, when the trial started, P.W.1, being the first informant and son of the deceased has turned hostile. D.BHARATHA CHAKRAVARTHY, J.

3. In view thereof, considering the nature of accident and the fact that it is pending from the year 2020, no useful purpose will be served and as such the case in C.C.No.22 of 2021 on the file of the Judicial Magistrate, Sathyamangalam Taluk, Erode, stands quashed. This Suo Motu Transfer stands disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
