ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 30.05.2019, the defacto complainant parked his two wheeler bearing Registration No.TN 73 P 7153 and on 31.05.2019, when he went to the spot for taking the vehicle, he found the same was missing. Subsequently, the case was called for an offence under Section 379 of IPC and the accused was apprehended. However, the motor cycle was recovered. The same is also handed over to the defacto complainant.

3. In this case, the accused - Mahender, son of Nathuram is a native of Madhya Pradesh. After enlargement on bail, he has disappeared. Every effort of the police to trace him in Madhya Pradesh has proved frutile for the past six years.

4. In view thereof, since the vehicle has already been handed over to the defacto complainant, no useful purpose will be served by keeping this case pending. However, keeping open the liberty of the prosecution to reopen the case, if in case the said Mahender is apprehended in any other case. The proceedings in C.C.No.11 of 2021 on the file of the Judicial Magistrate No.2 Court, Wallajahpet Taluk, Ranipet, stands quashed for the present. This Suo Motu Transfer stands disposed of.

21.08.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
