ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025.

2. In this case, the occurrence was in the year 2017. The first accused has already died. Summons have not been served on the other accused. Initially, summons were not served and later a warrant was issued, which is still pending. The defacto complainant is also not available at the given address and therefore no meaningful trial is possible. Even if the warrant is Page No.1 of 3

executed in the future, it would violate the right to a speedy trial.

3. Accordingly, the case in S.T.C.No.730 of 2019 on the file of the Judicial Magistrate Court No. II, Jayamkondam Taluk, Ariyalur, Salem shall stands quashed and this Suo Motu Transfer Case stands disposed of. 02.09.2025 nsl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
