ORDER

In this case, the allegation is that on 21.02.2020, the accused had picked up a sum of Rs.200/- from the picket of the de facto complainant and the de facto complainant noticed the same and even while the accused was alighting the bus and was trying to run away, he was caught red-handed and the sum of Rs.200/- was also recovered.

2. Under the said circumstances, an F.I.R in Crime No.109 of 2020 was registered on 21.02.2020. Even though the case is taken on file as Page No.1 of 3

C.C.No.466 of 2021, the case is pending for the past four years under the caption 'Fresh summons'. It is reported that the accused is not available in the said address. Even if summons are served on a future date and the accused is brought forward, it can be seen that by sheer efflux of time, the right to speedy trial of the accused shall stand impinged in view of the nature of the allegations. No useful purpose will be served in keeping the case pending.

3. Accordingly, the case in C.C.No.466 of 2021 of Judicial Magistrate No.3, Erode Taluk, Erode, shall stand quashed. This Suo Motu Transfer Case is disposed of.

21.08.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
