Selvam v. State Rep By
Crl.O.P.No.24373 of 2023 C.V.KARTHIKEYAN, J.
The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498(A), 294(b), 323, 324 and 506(2) of IPC in Crime No.269 of 2023, seek anticipatory bail.
2.The 1st petitioner is the husband of the injured / defacto complainant. The 2nd petitioner is the mother-in-law and the 3rd petitioner is the sister-in-law.
3.The learned counsel for the petitioners stated that there are no allegations against the 1st petitioner. He stated that the allegations are only against the 2nd petitioner that she had poured hot water on the shoulder and front upper portion of the defacto complainant, who suffered burnt injuries on her skin. It is stated that the 1st petitioner was in the office at the time of incident.
4.Taking all these facts into consideration, the earlier anticipatory bail petition had been dismissed on 19.09.2022 in Crl.O.P.No.21215 of 2023. Still there is no change in circumstances. 1/2 https://www.mhc.tn.gov.in/judis

5. I am not able to understand the necessity of the Court passing orders again and again and the respondent police not taking action, even if the anticipatory bail petition stands dismissed. The Investigating Officer, Mappedu Police Station, Tiruvallur, appears to be a person without any consciousness towards the duty. 6.Taking all these factors into consideration, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition stands dismissed. Atleast, now it is hoped that the respondent would act in accordance with law. 20.10.2023 smv Crl.O.P.Nos.24373 of 2023 2/2 https://www.mhc.tn.gov.in/judis
