O R D E R
This Writ Petition has been filed seeking for a direction to the respondents to issue patta for the petitioner's property comprised in Survey No.65A/1C Periyavadavadi Village, Vridhachalam Taluk, Cuddalore District having an extent of 20 cents in pursuant to the judgement passed in O.S.No.91 of 2008 on the file of the Court of Principal District Judge,
2. The learned counsel for the petitioner would submit that the petitioner purchased the aforesaid property from one Sagunthala vide Sale Deed dated 27.07.2000 and 26.11.2001. The petitioner has mutated patta in her name and thereafter she constructed a marriage hall in the said properties in the name of "Santhosh Arumugam Marriage Hall" after obtaining permission from the concerned authorities. The 2nd respondent vide his 2/6
proceedings in Na.Ka.V3/5324/2005 dated 05.05.2006 cancelled patta issued in favour of the petitioner for the abovementioned properties. Hence, the petitioner filed a suit for declaration and permanent injunction in O.S.No.91 of 2008 before the Court of Principal District Judge, Cuddalore District against the respondents in pursuant to the abovementioned properties. The said suit was decreed on 23.10.2008 in favour of the petitioner. Thereafter, the petitioner submitted a representation to the respondents to issue patta in his favour in pursuant to the abovementioned properties. But so far, no action was taken by the respondents. The petitioner has also applied for patta transfer application through online but survey No.65A/1 was removed from the official website. Therefore, again the petitioner submitted a representation to the respondents on 11.06.2025 to issue patta in his favour. As the same did not evoke any response, the petitioner has come forward with this writ petition.
3. Further, he would submit that as against the judgment and decree passed in O.S.No.91 of 2008, no Appeal has been filed till date. He therefore prays to allow this writ petition.

4. The learned Special Government Pleader appearing for the respondents on instructions would submit that no application has been filed by the petitioner seeking for issuance of patta. However, he would fairly submit that the since the suit was decreed in favour of the petitioner, the respondent concerned will issue patta in favour of the petitioner, after issuing notice to the petitioner.
5. Heard both sides. Perused the records.

Considering the facts and circumstances of the case and also upon the submissions made, since the suit was decreed in favour of the petitioner and as no appeal has been preferred as against the same, this Court directs the respondent concerned to issue patta to the petitioner's property pursuant to the judgement passed in O.S.No.91 of 2008 on the file of the Court of Principal District Judge, Cuddalore District, after issuing notice to the petitioner and the persons concerned, within a period of two weeks from the date of receipt of a copy of this order.
7. With the above directions, this writ petition is disposed of. No 4/6
costs.
