ORDER
This Miscellaneous petition has been filed to direct the respondent to publish the result of the first semester examination held for the students of the B.Ed Course in the petitioner Institution for the academic year 2024-2025 and to allow the students to write their examinations scheduled from 23.08.2025. 2.The learned Senior Counsel for the petitioner submitted that the denial of continuance of provisional affiliation is under challenge in Writ Petition No.36835 of 2024 in which the respondent so far not yet filed a counter affidavit. It is further submitted that, at the time of filing the writ petition, this Court vide order dated 04.02.2025 in W.M.P.No.39771 of 2024, granted interim relief by directing the respondent to open the portal to enable the students of the the petitioner College to appear for the first semester examination.
Since the Writ petition is still pending, the portal has not been opened for the second semester examination, which is scheduled to commence on 23.08.2025. It is also submitted that, despite the petitioner having been permitted to pay the examination fees, the respondent is refusing to issue the hall ticket. Hence, the learned senior counsel prays to grant an interim order.
3.Per contra, the learned Standing Counsel appearing for the respondent submitted that, since the affiliation of the petitioner college is under challenge, question of permitting the students to write their examination does not arise. It is further submitted that allowing the students to write the examination when the issue of provisional affiliation is pending adjudication could lead to complications, and in the event the writ petition is dismissed, the students one year postgraduate study would be wasted. Hence, the respondent prays to dismiss the present petition.
4.I have given my anxious consideration to either side submissions and also perused the materials available on record. 5.The fact remains that the writ petition is still pending and the respondent so far not yet filed any counter statement. Furthermore, the students of the petitioner college were permitted to write for the first semester examination pursuant to the order dated 04.02.2025. In view of the above, this Court finds that a prima facie case is made out in favour of the petitioner, therefore, inclined to allow the Writ Miscellaneous Petition. 6.In the result, the Writ Miscellaneous Petition is ordered, and the respondent is directed to open the portal forthwith to enable the petitioner to upload the students' particulars and permit the students to appear for the second
semester examination which is scheduled to commence on 23.08.2025. It is made clear that neither the petitioner nor the students of the petitioner shall claim equity based upon this order, and this order is subject to the outcome of the W.P.No.36835 of 2024.
