2. Heard Ms.Revathi, learned counsel appearing for Mr.R.Nalliyappan, for the appellant and Mr.S.Mukunth, learned counsel appearing for M/s.Sarvabhauman Associates, for the first respondent. Though the second respondent has been served none appears for the second respondent.

3. Accepting the reasons assigned in the affidavit filed in support of this application, this petition is allowed, the delay of 70 days in filing the Appeal is condoned.
