ORDER
The present writ petition has been filed with a prayer for mandamus directing the second respondent to revise the provisional list and allot the seat in the third respondent college in the Management Quota-Minority Network by considering the Petitioner's representation dated 18.08.2025.
2. The learned counsel for the petitioner would submit that the petitioner had secured 435 marks in NEET Examination and obtained a rank of 5172 under the Network Minority Management colleges. It is the submission of the petitioner that despite the petitioner scoring 435 marks, 2/7
another candidate by name Tivade Stephan Jeevan, who secured only 430 marks, was allotted a seat under the Network Minority Management quota/category. Hence, the learned counsel prays to interfere with the same.
3. Per contra, the learned Special Counsel appearing for the second respondent would submit that the petitioner does not fall within the merit criteria. It was further stated that the Network Management seats are allotted based on the list furnished by the third respondent Medical College according to merit, and since the petitioner did not qualify within that merit, her candidature was not considered. Apart from that, the learned Special Counsel would contend that the petitioner cannot be considered under either the Linguistic Minority Category or the Religious Minority Category, as she does not belong to State of Tamil Nadu.

In addition to the above submissions, the learned Senior Counsel appearing for the third respondent would invite the attention of this Court to Clause 1.14.1 of the Christian Medical College, Vellore Prospectus which pertains to undergraduate college recommendations for Christians under the Minority Network Category. It was pointed out that the candidate referred to 3/7
by the petitioner, and Tivade Stephan Jeevan, had been recommended by the Pune Christian Medical Association, and another candidate, Kalyani Gouda, was sponsored by the Jaipur Evangelical Lutheran Church. Hence, even though they had secured less marks than the petitioner, they were considered in terms of Clause 1.14.1 of the Prospectus.

It is further submitted by the learned Senior Counsel that, as per the said Prospectus, candidates who applied under the Minority Network Category but were not recommended by any Association or Council Member would be considered under the category of undergraduate college recommendation for Christians to the Minority Network Category. Under this category, the petitioner was ranked 300. The said list was forwarded to the second respondent, who, based on merit, allotted the seats accordingly. Therefore, the third respondent had no role in the non-selection of the petitioner.
5. I have given my anxious consideration to either side submissions and also perused the materials available on record. 4/7
6. The learned counsel for the petitioner would submit that it has been reliably learnt that Tivade Stephan Jeevan is now opting to join in Christian Medical College, Ludhiana. In such an event, if the petitioner comes within the merit, she seeks a direction from this Court to the respondents to consider her representation dated 18.08.2025.

Therefore, though this Court does not find sufficient grounds to issue a writ of mandamus, considering the petitioner's representation dated 18.08.2025, this Court deems it appropriate to direct the second respondent to consider the said representation and pass orders according to its own merits and in accordance with law. If the petitioner is found to fall within the merit, the respondents are at liberty to select the petitioner.
8. With the above observations, the writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition stands closed. 22.08.2025 ssi Index : Yes Speaking Order : Yes /No 5/7
