By consent, the writ petition itself is taken up for final disposal at the admission stage itself. 2.Heard Mr.D.Paariventhan, learned counsel appearing for the petitioner and Mrs.Karthika Ashok, learned standing counsel, who takes notice for respondents 1 to 3. 3.The petitioner herein being a widow has made a representation to the respondents seeking order to run road side
tiffin shop at Mdavellipakkam, 2nd Trust and now she has filed the present writ petition to issue Mandamus directing the respondents to dispose of her representation dated 21.01.2019. 4.The learned standing counsel appearing for the respondents Corporation submits that the petitioner is not running any shop in the said place and she has not made any application for allotment of the shop as per the Street Vending Act.
5.The vending activities on the street are now regulated and governing by the Street Vending Act, 2014. If any existing street vendor is carrying on trade in unauthorised place, they are identified and re-located by the Street Vending Committee at vending zone. While so, the request of the petitioner has to be considered only in accordance with the above said Act and Scheme and not otherwise. Hence, the prayer in the writ petition can not be considered. However, if the petitioner makes proper application to the Town Vending Committee, the same may be considered and appropriate order shall be passed as per the availability of the space.
