ORDER
The allegation in this case is that on 03.12.2020, the accused was seen to sell the Kerala Lotteries by noting down in the tokens and as such, a case was registered in Cr.No.1282 of 2020 on 03.12.2020. Thereafter, a final report was filed on 05.12.2020 for the offence under Section 7(3) of the Lotteries Regulation Act, 1998. The case is pending for the past five years for service of summons.

2. It is stated on behalf of the petitioner police that since the accused is not residing in the present address, they are unable to trace him.
3. Be that as it may, considering the nature of allegations, even if in future, the warrant is executed/summons is served, the continuation of the proceedings will impinge upon the right to speedy trial of the accused.
4. In view thereof, this is a fit case for exercise of power under Section 482 of Cr.P.C., and accordingly STC.No.883 of 2021 shall stands quashed and the Suo Motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
