ORDER

This case involves a small quantity i.e., only 10 grams of ganja allegedly found in the possession of the accused. A case was registered under Section 8(c) r/w. Section 20(b)(ii)(A) of the NDPS, Act, 1985 on 13.05.2019. Even though L.W.1 was examined, the matter is still pending. The accused Page No.1 of 2 https://www.mhc.tn.gov.in/judis

gsk was not available for the exercise of powers under Section 39 of NDPS Act. It is stated that the accused was released on probation and he was not to be found. The accused is said to have migrated to the State of Kerala and the respondent police are not able to locate him inspite of their best efforts. The case is now pending for the past six years.

2. Under these circumstances, no useful purpose would be served by keeping the matter pending. Accordingly, STC.No.121 of 2020 shall stands quashed and the Suo Motu Transfer Case stands allowed. 22.08.2025 gsk electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
