.. Respondent Prayer : Petition under Article 226 of the Constitution of India seeking issuance of a writ of certiorari calling for records of the DRAT in RA (SA) 132/2010, dated 15.12.2016 on the file of DRAT, Chennai and quash the same as illegal and arbitrary.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) After the matter was heard for some time and, in fact, when the court started dictating the judgment, counsels requested that an opportunity be given to amicably resolve the matter. The matter was, therefore, stood over to post-lunch session.

2. Both counsels, Mr.Arokia Sathish and Ms.Rachana Shankar, informed the court that their instructions are to settle the matter for a lumpsum amount of Rs.3 lakhs to be paid by petitioner to respondent bank.

3. Mr.Arokia Sathish states that the amount of Rs.3 lakhs shall be paid on or before 4.3.2025.

4. Ms.Rachana Shankar states that on receipt of this amount of Rs.3 lakhs, the property bearing Door No.6/1, Old Door No.6, Karaneeshwarar Koil Street, II Lane Mylapore, Chennai - 600 004, will be released from any mortgage or charge or like encumbrance and petitioner will be free to enjoy

the property, of which he is in possession, without any hindrance or obstruction or claim from Bank of India or any one claiming through it.

5. Ms.Rachana Shankar further states that there are no proceedings pending against the said property and if at all there are any proceedings pending, the same shall be withdrawn within four weeks from today.

6. In the light of the submissions made on either side, which are accepted as an undertaking to the court, the writ petition is disposed of. There shall be no order as to costs.
