CMP No.25831 of 2023 in CMA SR No.133555 of 2023 N.ANAND VENKATESH,J The fourth respondent remained ex parte before the Tribunal below and notice to him has already been dispensed with. Respondents 1 to 3 have been served with notice and they are represented through a counsel.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 326 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioner and the learned counsel for respondents 1 to 3 and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 326 days is condoned.

5. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for respondents 1 to 3 shall be printed in the cause-list.
