ORDER

The allegation in this case is that the Trustee of a temple had given a complaint that the Hundial which was kept outside the compound wall was broke open and the money was stolen on 11.03.2010. A case was registered in Cr.No.437 of 2010 and the accused viz., Arun @ Arun Kumar was implicated in the case and was remanded and released on bail. gsk Kumar became mentally ill and had gone out of the place and now, he is missing.

2. There is no reasonable prospect of the person being traced out. Under the said circumstances, even if he is brought he may not contest the case. Considering the nature of allegations, the continuation of the proceedings will impinge upon the right to speedy trial of the accused.

3. In view thereof, this is a fit case for exercise of power under Section 482 of Cr.P.C., and accordingly C.C.No.100089 of 2011 shall stands quashed and the Suo Motu Transfer Case stands allowed. 22.08.2025 gsk electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
